Asian Americans Advancing Justice – AAJC Celebrates Temporary Blocking of Trump’s Order Restricting Birthright Citizenship

Washington, D.C. — Today, a U.S. District Judge in New Hampshire granted class-action status to Barbara v. Donald J. Trump, a lawsuit aiming to protect individuals affected by President Trump’s executive order restricting birthright citizenship. The order certifies the class as including only affected babies, although the lawsuit also seeks to protect their parents. He also issued a temporarily block of President Trump’s executive order restricting birthright citizenship.
Asian Americans Advancing Justice – AAJC (Advancing Justice – AAJC) issues the following statement in response:
“We applaud the court’s decision to certify the class action lawsuit seeking to protect babies who would be affected by President Trumps’ executive order. We further commend the decision to temporarily block President Trump’s executive order from going into effect. Birthright citizenship is a fundamental constitutional right protected by the Fourteenth Amendment. Efforts to revoke this right threatens not only immigrant families but also undermines the very principles of equality and opportunity upon which our nation was built.
“The Asian American community has been at the forefront of affirming birthright citizenship ever since the landmark case of U.S. v. Wong Kim Ark. Together with the Washington Lawyers’ Committee for Civil Rights and Urban Affairs (WLC) and OCA – Asian Pacific American Advocates (OCA), we have amended our own lawsuit1 challenging President Trump's executive order, OCA — Asian Pacific American Advocates v. Rubio, to proceed as a class action. Last week, we asked a federal court to permanently stop enforcement of the unconstitutional executive order; today’s decision provides even further support for our position. We will continue the legal push to ensure that every child born in the U.S. is granted the rights afforded to them by the Constitution.”
