As of today, whether a person is eligible to vote or not, they are counted when district lines are drawn for determining representation in their state legislature. This case could change that so that not everyone is counted, but instead, only registered or eligible voters.

This case is a First Amendment issue as it relates to collective bargaining and political activity by labor unions. At issue is a question of whether collective bargaining by unions is political speech, and as such, whether the First Amendment requires that union members opt-in, rather than requiring them to opt-out, as currently required.
